These Terms & Conditions explain the rules that apply when you use the NARIYA OUD website, contact us, request product information or place an order. Please read them before using the website or purchasing a product.
Nothing in these Terms limits rights that cannot lawfully be excluded or restricted.
1. Website Use
You may use this website for lawful personal purposes and to learn about NARIYA OUD, contact us or purchase products when ordering is available.
You must not misuse the website, attempt unauthorised access, interfere with security or operation, introduce harmful code, submit false or fraudulent information, scrape the website at unreasonable scale, or use its content in violation of another person’s rights.
We may restrict access where reasonably necessary to protect the website, our customers or our rights.
2. Product Information
We aim to describe products, sizes, packaging and available documentation accurately. Images are illustrative, and colours and details may appear differently because of lighting, photography, display settings or packaging updates.
Please review the information shown on the relevant product page before ordering and contact us if you need clarification.
3. Natural Batch Variation
Agarwood oil is made from naturally variable material. Aroma, colour, density and character may therefore differ between batches or samples.
Natural variation alone does not necessarily mean that a product is defective. This does not affect any rights you may have if a product is damaged, incorrect, misdescribed or otherwise fails to meet applicable legal requirements.
4. Product Use and Safety
Use products only as described on the product page, packaging or accompanying instructions. Agarwood oil offered for personal fragrance use is for external use only. Use a small amount, avoid contact with the eyes, keep products away from children and discontinue use if irritation occurs.
If you have allergies, sensitive skin, a health condition, are pregnant or are unsure whether a product is suitable for you, seek appropriate professional advice before use. Website content is general product information and is not medical advice.
5. Availability
Products, sizes and batches are subject to availability. Displaying a product does not guarantee that it can be supplied.
We may limit quantities, withdraw a product, or decline an order where stock is unavailable, destination requirements cannot be met, information is incomplete, or there is a pricing, technical, security or legal issue. If payment has already been taken for an order we cannot fulfil, the relevant amount will be returned using an appropriate method.
6. Prices and Payment
Website and checkout prices are displayed in United States dollars (USD). The price and any charges presented during checkout will apply to the order, subject to correction of obvious errors before acceptance. Shipping, taxes, duties, bank charges or currency conversion costs may be shown separately or charged by third parties where applicable.
Available payment methods will be displayed at checkout. These may include PayPal Business and card payment where those options are enabled. Payment may be handled by an independent provider under its own terms, privacy notice and security procedures. We do not control fees or exchange rates applied by a bank or payment provider.
7. Orders
Submitting an order is an offer to purchase the selected products. An order is accepted only when we send an acceptance or dispatch confirmation, or otherwise clearly confirm acceptance.
You are responsible for checking product, quantity and contact and delivery information before submitting an order. Please contact us promptly if you notice an error. You may request cancellation before the order is dispatched. After dispatch, an order cannot be cancelled and any request must be considered under the Returns & Refunds policy.
We may use reasonable checks to prevent fraud and may request further information before accepting or fulfilling an order.
8. Shipping and Customs
Initial sales are intended for customers in the United States, Canada, the United Kingdom and Australia, subject to the destination options available at checkout. Orders are dispatched directly from our factory in Vietnam. Shipping options and charges will be shown before an order is submitted.
Orders are normally processed within 2–5 business days. International delivery is estimated at 7–15 business days after dispatch. These periods are estimates, not guaranteed delivery dates. Customs procedures, import restrictions, duties, taxes, carrier disruption and destination requirements may affect delivery. You are responsible for providing an accurate, complete delivery address and any information reasonably required for shipment or customs processing.
Orders are not sent on a duties-paid or DDP basis. Import duties, value-added tax, customs-clearance charges and other destination charges are the customer’s responsibility.
9. Returns and Refunds
A request for an ordinary return must be made within 7 days after delivery. Ordinary returns are limited to products that are unopened, unused and in complete original packaging. Opened or used products, products with a broken seal, and products whose storage condition cannot be verified are generally not accepted as ordinary returns.
All return requests must first be sent to info@nariyaoud.com and receive return authorisation and instructions. Parcels sent back without prior approval will not be accepted or processed. For a non-quality return, the customer is responsible for return shipping costs.
If an item is incorrect, damaged, leaking or has a clear quality issue, keep the product and packaging and contact us promptly with the order details and reasonable supporting information. We may offer a refund or replacement as appropriate, and we will cover reasonable authorised return shipping costs for an incorrect item or confirmed quality issue.
Approved refunds are submitted for processing within 5–10 business days after the necessary review or inspection. Additional time may be required by the original payment provider or bank. These rules do not remove consumer rights that cannot lawfully be excluded.
10. Accounts
If customer accounts are offered, you are responsible for keeping your details accurate and protecting your login credentials. Tell us promptly if you believe an account has been accessed without permission.
We may suspend or restrict an account where reasonably necessary for security, fraud prevention, legal compliance or investigation of misuse.
11. Communications
You must provide contact information that is accurate and accessible. We may send service messages relating to enquiries, orders, payments, shipping, returns, security or changes affecting a transaction.
Transactional and security messages are separate from marketing communications. Marketing preferences can be managed through the method provided with the relevant message or service.
12. Intellectual Property
Unless otherwise stated, the website and its original text, branding, product names, logos, photographs, graphics, layout and other materials are owned by or licensed for use by NARIYA OUD.
You may view and retain reasonable copies for personal use. You must not reproduce, modify, distribute, sell, commercially exploit or falsely attribute protected material without permission or another lawful basis.
13. Third-Party Services
The website may use or link to services provided by third parties, including hosting, analytics, communications, payment, shipping or social platforms. Those providers may apply their own terms and privacy notices.
We are not responsible for third-party content or services that we do not control, but this does not limit responsibility that cannot lawfully be excluded.
14. Website Availability
We aim to keep the website accurate, secure and available, but uninterrupted or error-free operation cannot be promised. Access may be suspended or limited for maintenance, updates, security, operational or legal reasons.
We may correct errors and update website or product information. If a material error affects an order, we will review the circumstances and communicate the available options.
15. Liability and Mandatory Consumer Rights
Nothing in these Terms excludes or limits liability, remedies or consumer rights where doing so is prohibited by law.
Subject to those mandatory protections, we are not responsible for losses that were not reasonably foreseeable when a contract was formed, losses caused by information or actions outside our reasonable control, or business losses arising from a consumer’s personal use of the website or products.
You remain responsible for following product instructions and for ensuring that your use of the website and products is lawful and appropriate for your circumstances.
16. Events Outside Reasonable Control
We are not responsible for delay or failure caused by events outside our reasonable control, such as severe weather, natural events, public authority action, customs intervention, transport or supply disruption, labour disruption, public health measures, power failure or communications failure.
Where reasonably possible, we will take proportionate steps to reduce the effect of the event and communicate material delays affecting an accepted order.
17. Privacy
Our Privacy Policy explains how personal information is collected, used and protected when you visit the website, contact us or place an order.
18. Changes to These Terms
We may update these Terms to reflect changes to the website, products, services, legal requirements or business operations. The updated version and revision date will be shown on this page.
Changes will not remove mandatory rights relating to an order already accepted. Where appropriate, the version in effect when an order was accepted will continue to govern that order.
